Independent adviser on ministerial standards Laurie Magnus informed Starmer that Rayner could not be considered to have met the “highest possible standards of proper conduct.” This determination placed her in breach of the ministerial code.

In her resignation letter, Rayner expressed deep regret about not seeking specialist tax advice. “I would like to take this opportunity to repeat that it was never my intention to do anything other than pay the right amount,” she stated.
She also cited the impact on her family: “I must also consider the significant toll that the ongoing pressure of the media is taking on my family.”

The tax issue arose from complicated family circumstances. Rayner revealed she has an arrangement with her ex-husband concerning care for their disabled son, involving another property that remains a family home.
This arrangement affected her tax obligations under England’s stamp duty rules.
Stamp Duty Rules Explained
Under English property tax regulations, anyone purchasing a second property must pay an additional surcharge. Rayner initially classified her new seaside flat in Hove as a primary residence, subjecting it only to the basic stamp duty rate.
However, because of the additional family home held in trust for her son, she owed an estimated £40,000 more to tax authorities than initially calculated.
